The only thing needed if you want it to be xhtml compliant is to change this part :
ubb=get_topic&f=$x&t=$last_post_number
to this:
ubb=get_topic;f=$x;t=$last_post_number

Oh.. crap. Alright, dont install the modification to use colors or you will get errors on other pages that dont use the pop up.... hmmm... anyone know a way to do this without getting errors?

i installed hypercells v3 and now the last post extender doesn't seem to be working. . any possible relation?

Yes, a step in hypercells overwrites part of the last post extender, you will need to rehack public_forum_summary.pl.
